# Terms of Service – akihabara-vintage-store

These Terms of Service (“Terms”) govern your access to and use of the online store operated by Emerald LLC under the store name akihabara-vintage-store (“we,” “us,” or “our”), including your purchase of products from our website (the “Site”).

By accessing the Site, creating an account, placing an order, or using our services, you agree to these Terms and to our Shipping Policy, Return Policy, Privacy Policy, and Legal Notice.

Before placing an order, please carefully review:

Unless expressly stated otherwise, only the items shown in the product photographs or specifically listed in the product description are included.

## 5. Vintage and Pre-Owned Condition

Vintage and pre-owned products may have characteristics including:

- Scratches, scuffs, dents, or wear
- Discoloration or fading
- Dust, debris, haze, or minor internal contamination
- Aging or deterioration of leather, rubber, seals, coatings, adhesives, or lubricants
- Variations in mechanical accuracy
- Cosmetic or functional characteristics associated with age and previous use
- Repairs, replacement parts, or servicing performed before our ownership where known or disclosed

Conditions visible in the photographs or disclosed in the product description are not considered defects.

Descriptions such as “Near Mint,” “Excellent,” or similar condition terms are general assessments and do not mean that the product is new or free from all signs of use.

The customer is responsible for reviewing the complete product page rather than relying solely on the product title or condition category.

## 6. Product Operation and Maintenance

Vintage cameras, watches, lenses, and mechanical or electronic equipment may require periodic maintenance, servicing, adjustment, battery replacement, or consumable-part replacement.

Unless an express warranty is stated on the product page, we do not guarantee:

- Future operation for any specific period
- Long-term accuracy or performance
- Water resistance
- Continued availability of parts
- Compatibility with every accessory, device, film, battery, strap, lens, or system
- Performance after repair, adjustment, disassembly, modification, impact, water exposure, magnetism, or improper storage

Any test results, accuracy measurements, or operational observations shown on the product page reflect the condition at the time of inspection and may vary due to transportation, temperature, usage, position, battery condition, or other factors.

Customers should not assume that a vintage watch is water-resistant unless expressly stated.

## 7. Product Availability

Many of our products are unique items, and inventory may be shared across multiple sales channels.

Although we take reasonable steps to maintain accurate inventory, an item may occasionally become unavailable after an order is placed due to:

- A simultaneous sale on another platform
- An inventory synchronization delay
- Damage or a newly discovered defect before shipment
- An inventory or listing error
- Loss or inability to locate the item

If we cannot fulfil an order, we may cancel the affected order and issue a full refund to the original payment method.

We are not obligated to provide a substitute product, but we may offer alternatives where appropriate.

## 8. Prices and Listing Errors

Product prices are displayed on the relevant product pages.

We make reasonable efforts to ensure that prices, descriptions, photographs, specifications, and availability information are accurate. However, errors may occur.

If a listing contains an obvious pricing error, material description error, incorrect product information, or technical error, we may:

- Contact you to confirm whether you wish to proceed under the corrected terms
- Correct the listing
- Cancel the order
- Issue a full refund where payment has already been made

An automated order confirmation does not require us to fulfil an order based on an obvious or material error.

We will not increase the agreed product price after accepting an order, except for charges separately disclosed at checkout or charges arising from circumstances attributable to the customer.

## 9. Orders and Contract Formation

Placing an order constitutes an offer to purchase the selected product.

After an order is placed, you may receive an automated confirmation email. This confirms that we received the order but does not necessarily mean that the order has been finally accepted.

We may review an order before acceptance for purposes including:

- Product availability
- Payment authorization
- Fraud prevention
- Sanctions and legal compliance
- Address verification
- Customs or shipping restrictions
- Errors in price or product information

The sales contract is formed when we accept the order and begin processing it for shipment, unless applicable law requires otherwise.

## 10. Order Refusal and Cancellation

We may refuse, hold, or cancel an order where reasonably necessary, including when:

- We reasonably suspect fraud, unauthorized payment, or identity misuse

- The product is unavailable
- The listing contains a material error
- The customer has previously engaged in abusive, fraudulent, or materially improper conduct
- The order creates an unreasonable safety, legal, or operational risk

If we cancel an order after receiving payment, we will refund the eligible amount to the original payment method.

We will not cancel an order solely because the purchaser may intend to resell the product.

## 11. Resale of Products

Customers may purchase products for personal use, collection, business use, or lawful resale.

Resale itself is not prohibited.

However, a purchaser must not:

- Claim to be an authorized dealer, representative, partner, or affiliate of Emerald LLC or akihabara-vintage-store without our written permission
- Use our company name, store name, trademarks, photographs, descriptions, logos, or other content in a way that falsely suggests authorization or affiliation
- Make false or misleading statements about a product’s condition, authenticity, origin, servicing history, or relationship with us
- Remove, alter, or misrepresent serial numbers or identifying information
- Use our Site or services for unlawful trade, sanctions evasion, fraud, or prohibited exports

Any resale transaction between a customer and a third party is independent of us. We are not responsible for claims, warranties, representations, returns, or disputes arising from the customer’s subsequent resale of a product.

## 12. Payment

We accept major credit cards and PayPal.

Payment is processed at the time the order is placed.

Payment services may be provided by Shopify, PayPal, card networks, banks, or other third-party payment providers. Their separate terms and privacy policies may apply.

You confirm that:

- You are authorized to use the selected payment method.
- The billing information provided is accurate.
- Sufficient funds or credit are available.
- The transaction does not involve unauthorized or fraudulent payment activity.

We may request additional verification for high-value, unusual, or potentially high-risk transactions.

Failure to complete requested verification may result in an order being delayed or cancelled.

## 13. Shipping

Orders are normally prepared and dispatched within 2–3 business days after payment confirmation.

All orders are shipped by DHL Express with tracking.

Shipping is free to the destinations listed in our Shipping Policy, and the standard shipping cost is included in the product price.

Delivery estimates are not guaranteed. Delivery may be affected by customs clearance, carrier operations, local conditions, holidays, weather, security events, or other circumstances outside our reasonable control.

## 14. Import Duties, Taxes, and Customs

### United States

Orders shipped to the United States are sent on a Delivered Duty Paid (DDP) basis.

Applicable import duties, taxes, and customs charges are calculated and collected separately at checkout.

Once the amounts displayed at checkout have been paid, no additional import duties, taxes, or customs clearance charges will normally be required upon delivery.

### Destinations Outside the United States

Orders shipped to other destinations are sent on a Delivered Duty Unpaid (DDU) basis.

The customer is responsible for:

- Import duties
- Taxes
- Customs clearance fees
- Brokerage charges
- Local processing charges
- Any other charges imposed by the destination country or carrier

Customers must cooperate with customs authorities and DHL and provide any required identification, tax numbers, telephone numbers, or documentation.

We cannot declare a false value, reduce the declared value, mark a commercial order as a gift, or provide false customs information.

## 15. Delivery Address

Orders will be shipped to the address entered and confirmed at checkout.

The customer is responsible for ensuring that the following information is complete and accurate:

- Recipient name
- Street address
- Building and unit information
- City and region
- Postal code
- Country
- Telephone number
- Email address

We may be unable to change an address after shipment processing begins.

Costs caused by an incorrect address, requested address change, unsuccessful delivery, refusal, or failure to complete customs procedures may be charged to the customer.

We may decline requests to ship to an address other than the address recorded in the order.

## 16. Risk of Loss and Delivery

Risk of loss and legal ownership transfer in accordance with applicable law and the agreed delivery terms.

A carrier’s tracking record showing delivery to the address provided at checkout may be used as evidence of delivery, subject to applicable consumer law.

If a package appears lost or damaged in transit, contact us promptly so that we can investigate the matter with the carrier.

The customer must preserve the package, shipping label, packing materials, and item while an investigation is underway.

## 17. Returns and Refunds

Return requests must be made within 14 days after delivery.

All returns require prior authorization.

Return eligibility, return shipping costs, inspection procedures, deductions, excluded items, and refund conditions are governed by our Return Policy.

The following actions may affect or eliminate return eligibility:

- Use or wear after delivery
- Repair or attempted repair
- Disassembly
- Adjustment or modification
- Cleaning that changes or damages the item
- Removal or alteration of serial numbers, security labels, or identifying marks
- Removal or replacement of parts
- Failure to return accessories, documentation, boxes, or other included items
- Damage caused after delivery

Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable consumer-protection laws.

## 18. Damaged, Defective, or Incorrect Products

Customers should inspect products promptly after delivery.

- Photographs of the shipping label
- Photographs of the packing materials
- Photographs or video of the product
- A clear image of the serial number
- A video demonstrating the reported problem

Do not repair, disassemble, adjust, clean, or modify the product before receiving instructions from us.

You must not use the Site:
